 SENATOR MILLER announced  SB 339  (MANAGEMENT OF STATE LAND AND               
 RESOURCES) to be up for consideration.                                        
                                                                               
 TERESA SAGER-STANCLIFF, Staff for Senate Resources, explained that            
 the work draft to SB 339 contains a few technical and conforming              
 changes.  The substantive changes are that in the original bill,              
 sections 16 - 18 were removed, along with similar sections in the             
 repealer at the end of the bill.  Section 11 of the original bill,            
 which is section 10 of the work draft, rewrites the section                   
 regarding native allotments to reflect SB 293 that was passed by              
 this committee a few weeks ago.                                               
                                                                               
 Also, in the back of the bill, section 38 of the original bill was            
 listed as a transitional provision.  It has been redrafted as                 
 section 32 which would become codified law.                                   
                                                                               
 Section 29 of the work draft is a rewrite of the provisions of                
 AS38.08.040, a technical change, MS. STANCLIFF said.                          
                                                                               
 CHRIS MAISCH, Director of the Forestry Program for Tanana Chief's             
 Conference, said they would like to delete "or will perpetuate" and           
 insert "due to" on page 9, line 19 of the draft bill.  He suggested           
 adding "fire" to "due to insects or disease epidemics".

 SENATOR LEMAN moved to adopt the CS to SB 339.  There were no                 
 objections and it was so ordered.                                             
                                                                               
 GERRY GALLAGHER, DNR, supported the Mr. Maisch's suggestions.                 
                                                                               
 SENATOR MILLER offered Mr. Maisch's language as an amendment.                 
 There were no objections and it was so ordered.                               
                                                                               
 SENATOR ADAMS commented that he and Senator Zharoff had a problem             
 with section 12.  MR. GALLAGHER said this is one of the changes               
 that was made to conform with a Supreme Court decision about the              
 requirement to be physically present at an auction and that the               
 auction be held in the specific community.  The Supreme Court said            
 those things can't be required.                                               
                                                                               
 SENATOR LEMAN moved to pass CSSB 339(RES) from committee.  There              
 were no objections and it was so ordered.
